These Terms of Use (“Terms”) govern your access to and use of the websites, services, and content offered by Best Local Service Pros LLC (“Best Local Service Pros,” “we,” “us,” or “our”), including www.bestlocalservicepros.com and business.bestlocalservicepros.com (together, the “Sites”). By accessing or using the Sites, creating an account, or purchasing a membership, you agree to be bound by these Terms. If you do not agree, please do not use the Sites.
1. About the Service
Best Local Service Pros operates an online local-business directory that helps Michigan residents (“Consumers”) discover and connect with independent local service professionals (“Service Pros”), and helps Service Pros list their businesses and receive customer inquiries. We are a venue and intermediary only. We do not perform, supervise, or deliver any of the services offered by Service Pros, and we are not a party to any agreement, transaction, or communication between Consumers and Service Pros.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Sites. By using the Sites you represent that you meet these requirements and that any information you provide is accurate and current.
3. Accounts
To access certain features you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that contain false information or that violate these Terms.
4. Memberships, Billing, and Cancellation
- Plans. Service Pros may create a free Starter listing or subscribe to a paid plan (currently Growth and Pro). Plan features and prices are described on our pricing page and may change from time to time.
- Recurring billing. Paid plans are offered on a monthly or annual basis and automatically renew at the end of each billing period at the then-current rate until cancelled. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis.
- Payment processing. Payments are processed by third-party providers (including Stripe). We do not store full payment-card numbers. Your use of payment services is subject to the processor’s terms.
- Cancellation. You may cancel a paid membership at any time from your account dashboard. Cancellation stops future renewals; your plan remains active through the end of the current billing period unless a refund is issued.
- Refunds. If you cancel a paid membership, you may request a pro-rated refund for the unused portion of your then-current billing period. Refunds are issued to the original payment method. Free Starter listings carry no charge and are not eligible for refunds.
- Price changes. We may change plan pricing or features. Changes to recurring prices will not take effect until your next billing period, and we will provide notice where required by law.
5. Business Listings and Member Content
Service Pros are responsible for the accuracy of their listings, including business name, contact details, services offered, licensing, and any claims made. You grant Best Local Service Pros a non-exclusive, royalty-free license to host, display, reproduce, and promote your listing and submitted content on and in connection with the Sites. You represent that you have the rights to all content you submit and that it does not infringe any third party’s rights or violate any law. We may edit, decline to publish, or remove any listing or content at our discretion, including listings that are inaccurate, misleading, or in violation of these Terms.
6. Reviews and User-Generated Content
Consumers may submit reviews, ratings, and other content. You agree that your submissions are truthful, based on genuine first-hand experience, and not posted in exchange for compensation. You may not post content that is false, defamatory, harassing, obscene, infringing, or otherwise unlawful. You grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your submissions in connection with the Sites. We do not guarantee that any review reflects the views of Best Local Service Pros, and we may moderate, decline, or remove content at our discretion. We are not responsible for the content of user submissions.
7. Acceptable Use
You agree not to: (a) use the Sites for any unlawful purpose; (b) submit false, misleading, or fraudulent information; (c) post fake or incentivized reviews; (d) scrape, harvest, or collect data from the Sites without our written permission; (e) interfere with or disrupt the Sites or their security; (f) impersonate any person or business; or (g) use the Sites to send spam or unsolicited communications.
8. Relationship With Service Pros — Important Disclaimer
Best Local Service Pros does not employ, endorse, recommend, guarantee, background-check, or otherwise vet the Service Pros listed in the directory, and listing on the Sites does not constitute an endorsement. We make no representations or warranties regarding the qualifications, licensing, insurance, conduct, pricing, availability, or quality of work of any Service Pro. Any decision to engage a Service Pro — and the terms of that engagement — is solely between the Consumer and the Service Pro. You are responsible for verifying a Service Pro’s credentials, licensing, insurance, and suitability before hiring, and you engage Service Pros at your own risk. Best Local Service Pros is not liable for the acts, omissions, services, or conduct of any Service Pro or Consumer.
9. Intellectual Property
The Sites, including their design, text, graphics, logos, and software, are owned by or licensed to Best Local Service Pros and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Sites for their intended purpose. You may not copy, modify, distribute, or create derivative works from the Sites without our written permission, except for content you own.
10. Disclaimers
The Sites and all content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Sites will be uninterrupted, secure, or error-free, or that any information (including listings and reviews) is accurate or complete.
11. Limitation of Liability
To the fullest extent permitted by law, Best Local Service Pros and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Sites or your dealings with any Service Pro or Consumer. To the fullest extent permitted by law, our total liability for any claim relating to the Sites will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless Best Local Service Pros and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Sites, your content, your violation of these Terms, or your dealings with any Service Pro or Consumer.
13. Privacy
Your use of the Sites is also governed by our Privacy Policy, which explains how we collect and use information. Please review it to understand our practices.
14. Third-Party Links and Services
The Sites may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third party, and access to them is at your own risk.
15. Termination
We may suspend or terminate your access to the Sites at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, the rights granted to you under these Terms will end. Sections that by their nature should survive termination will survive.
16. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent changes. Material changes will be posted on the Sites, and your continued use after changes become effective constitutes acceptance of the revised Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Sites will be resolved exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of those courts.
